ABOUT THESE T&CS

The following Terms and Conditions have been prepared to help you make the most of mindbodymat.com. Please take a fee moments to read them thoroughly. We reserve the right to change these terms and conditions and therefore users should check them regularly. 

These terms and conditions have been updated to reflect the current operation of Mind Body Mat during the COVID-19 pandemic. For standard T&Cs, please contact sarah@mindbodymat.com.


By booking and/or attending any class or engaging with online content published by Mind Body Mat, including but not limited to this website, YouTube and Social Media Channels, you agree to the following terms and conditions.

DEFINITIONS

MIND BODY MAT is a trading name of Sarah Jaques, who operates as a sole trader. 

PARTICIPANT means any individual who books or attends a class or engages with any content published by Mind Body Mat. 

1. COVID-19 CONSENT

The following declaration applies to participants taking part in Indoor and Outdoor Group classes.

You knowingly and willingly consent to participating in Pilates classes with Mind Body Mat during the COVID-19 pandemic.

You confirm that you have not had any of the following symptoms in the 10 days prior to your class: fever, shortness of breath, loss of sense of taste or smell, dry cough, runny nose or sore throat. In the event that you experience symptoms of COVID-19 in the future, you will advise your Instructor and will not attend class. 


You confirm that you have not been living in a household with a possible COVID-19 infection. In the event that someone you live with experiences possible symptoms of COVID-19 in the future, you will advise your Instructor and will not attend class. 


You confirm that you are not classified as extremely vulnerable on health grounds. If you do come under the category of an extremely vulnerable person, you can confirm that you understand the risk of participating this activity and accept this risk.


Where necessary to help stop the spread of COVID-19, you consent to your personal details being passed to an NHS Contact Tracer for the purposes of the NHS Test and Trace Scheme. Your Full Name and Telephone Number, along with the time(s) and date(s) of your Pilates Class will be used. No other personal information will be shared under this scheme.


Where applicable, you will register at reception when arriving at your class venue and if possible you will use the NHS Test and Trace QR code system to check in on your mobile device.

2. LIABILITY

Participants are required to complete a Health Questionnaire (PAR-Q) which contains specific health history questions. It is the participant's responsibility to ensure that they are capable of undergoing the exercises provided in any class they attend and to advise of any changes to their physical well being. 

Participants are required to follow the direction of the Instructor at all times while attending a class. 

Participants are required to inform Sarah (or a cover instructor) if they incur injuries or conditions, after the initial information stated on their PAR-Q.

Participants will be taking part in physical exercise at or near the extent of their capacity and that there is a possible risk of injury, harm or aggravation to pre-existing medical conditions. All Participant's agree that they are voluntarily engaging in physical exercise and by signing the PAR-Q and taking part in an exercise class, Participants fully assume the risk of injury or harm. Participants agree that the instructor cannot be held responsible for any injuries or ill health arising from their participation in face to face or online classes.

Advice provided by Instructors at no time constitutes medical advice in substitute for advice provided by a medical professional. 

Personal belongings are brought into the premises at the Participant's own risk and we do no t accept liability for any loss of damage whatsoever to such items. 

Links from or to web sites outside mindbodymat.com are meant for convenience only. We do not review, endorse, approve or control, and are not responsible for any sites linked from or to mindbodymat.com, the content of those sites, the third parties names therein, or their products and services. 

3. INDOOR CLASSES

BOOKING & PAYMENT

All indoor classes must be booked in advance. Your booking will not be confirmed until payment is received.


Classes run in terms of 4-7 weeks in length. You can secure your place in a class for the term at a reduced rate, or pay-as-you-go subject to availability. If you join partway through a term, your fee will be pro rata'd. Electronic bank payment (BACs) is preferred. All pre-payments are non-refundable and non-transferable. 


At the end of each term, you will be invited to sign up for the next term.

Please note your space will not be guaranteed until your next term payment is received. 

CANCELLATIONS & NO SHOWS

Payment for missed classes cannot be carried forward to the next term/block. If you cannot make a class due to holiday or sickness, you will be offered the chance to book into a "make-up class" during the term (subject to availability, in-person and online). You will also be given access to a library of on-demand classes.

4. ONLINE CLASSES (ZOOM)

BOOKING & PAYMENT

Classes must be booked in advance. Your booking will not be confirmed until payment is received.


Classes run in terms of 4-7 weeks in length. You can secure your place in a class for the term at a reduced rate, or pay-as-you-go subject to availability. If you join partway through a term, your fee will be pro rata'd. Electronic bank payment (BACs) is preferred. All pre-payments are non-refundable and non-transferable. 


At the end of each term, you will be invited to sign up for the next term.

Please note your space will not be guaranteed until your next term payment is received. 

CANCELLATIONS & NO SHOWS

Payment for missed classes cannot be carried forward to the next term. You may be offered the chance to book into a "make-up class" during the term (subject to streaming availability) and will otherwise be given access to a library of on-demand classes. 

5. LIVE STREAM ONLINE CLASS LIABILITY WAIVER

Live stream online classes are intended solely for the use of MBM Pilates clients.


Please ensure your workout area is safe; for example, sufficient space to move freely without obstacles or obstruction, sufficient heating, lighting, and stay hydrated, etc.


You must complete a PAR-Q prior to joining an online class. Please be advised that if you have ticked any risk factors on the PAR Q form, you should have approval from a GP or medical professional prior to participation in the exercise activity and follow any specific guidelines/ recommendations provided by your GP.  


The classes will contain exercises suited to beginner/intermediate level participants. Please work within your own capability. If you have any difficulty or pain when performing these exercises, please stop immediately. Adaptions and modifications can be given for exercises. 


Participation is at your own risk and Mind Body Mat Pilates will not accept liability for any injury arising as a result of your participation. 


By booking this class, you agree to these terms and conditions and understand that you will be taking part in physical exercise at or near the extent of your  capacity and that there is a possible risk of injury, harm or aggravation to pre-existing medical conditions. You confirm that I you are voluntarily engaging in physical exercise and fully assume the risk of injury or harm. You understand that the instructor cannot be held responsible for any injuries or ill health arising from your participation. 

6. RECORDED ONLINE CLASS LIABILITY WAIVER

Recorded classes are intended solely for the use of MBM Pilates clients who have attended at least one face to face class and completed a PAR-Q.


Please ensure your workout area is safe; for example, sufficient space to move freely without obstacles or obstruction, sufficient heating, lighting, and stay hydrated, etc.


Please be advised that if you have ticked any risk factors on the PAR Q form, you should have approval from a GP or medical professional prior to participation in the exercise activity and follow any specific guidelines/ recommendations provided by your GP.  


Recorded classes contain exercises which are generally suited to beginner/intermediate level participants. Please work within your own capability. If you have any difficulty or pain when performing these exercises, please stop immediately. You can contact Sarah on sarah@mindbodymat.com or 07810 581508 to discuss suitable modifications or adaptations to these exercises. For insurance reasons I am not able to offer advanced options for the exercises - get in touch if you'd like further guidance.

By watching any recorded classes published by Mind Body Mat, you agree to these terms and conditions and understand that you will be taking part in physical exercise at or near the extent of your  capacity and that there is a possible risk of injury, harm or aggravation to pre-existing medical conditions. You confirm that I you are voluntarily engaging in physical exercise and fully assume the risk of injury or harm. You understand that the instructor cannot be held responsible for any injuries or ill health arising from your participation. 


Please do not share any online video content, it remains the copyrighted property of Mind Body Mat Pilates. 

7. PRIVATE CLASSES

PAYMENT

Payment in advance will be requested to secure your booking - electronic bank payment (BACs) is preferred. All pre-payments are non-refundable.

CANCELLATIONS & NO SHOWS

All Private, Small Group or other specifically scheduled classes require cancellation 24 hours in advance of the class start time. If you fail to give appropriate notice, you will be charged the 50% of the full fee.

8. CHANGES TO YOUR CLASS

Mind Body Mat reserves the right to make alterations to classes, instructors and/or equipment.

CANCELLED CLASSES

MBM Pilates reserves the right to cancel classes due to low attendance, emergency or planned holiday. Participants will be notified in advance, where possible. In the event your class is cancelled, you will be given the option to re-book into an alternative class or request a refund/credit for the missed class.

COVID-19

In the event in-person classes are cancelled due to the COVID-19 pandemic, your block payment can be frozen and used as a credit when returning to classes. If your online class is cancelled, you will be offered an alternative class or refund. 

9. PHOTO & VIDEO RELEASE

Mind Body Mat Pilates reserves the right to take photographs or videos of participants during classes and to record online classes. Mind Body Mat Pilates has full and unrestricted rights to use these photographs and videos on, but not limited to, our website and social media. Please contact us if you specifically do not want to be included in this policy.

10. COPYRIGHT

Any marketing, educational or other material whatsover produced by Sarah Pearsall T/A Mind Body Mat, will at all times remain the property of Sarah Pearsall and will be subject to Sarah Pearsall's copyright.

11. PRIVACY POLICY

This privacy policy tells you how we use personal information collected at this site and by Mind Body Mat. Please read this privacy policy before using the site or submitting any personal information. By using the site (or any associated platforms and booking sites), you are accepting the practises described in this privacy policy. These practices may be changed. You are encouraged to review the privacy policy whenever you visit the site to make sure that you understand how any personal information you provide will be used. 

Any unprotected E-Mail communication over the Internet is, as with communication via any other medium (e.g. cellular phones, post office mail), not confidential, subject to possible interception or loss, and is also subject to possible alteration. 

COLLECTION OF INFORMATION

I may collect personal identification information from users in a variety of ways, including, but not limited to, when users visit mindbodymat.com, fill out a form, and in connection with other activities, services, features or resources I make available online. I will collect personal identification information from users only if they voluntarily submit such information and all personal data is store securely. 

COOKIE/TRACKING TECHNOLOGY

This website may use cookie and tracking technology depending on the features offered. Cookie and tracking technology are useful for gathering information such as browser type and operating system, tracking the number of visitors to the Site, and understanding how visitors use the Site. Cookies can also help customise the Site for visitors. Personal information cannot be collected via cookies and other tracking technology, however, if you previously provided personally identifiable information, cookies may be tied to such information. Aggregate cookie and tracking information may be shared with third parties.


 DISTRIBUTION OF INFORMATION


I may share information with governmental agencies or other companies assisting us in fraud prevention or investigation. I may do so when: (1) permitted or required by law; or, (2) trying to protect against or prevent actual or potential fraud or unauthorised transactions; or, (3) investigating fraud which has already taken place. The information is not provided to these organisations for marketing purposes.

In addition, your information may be shared with an NHS Contact Tracer if necessary to prevent the further spread of the COVID-19 virus. 


GDPR COMPLIANCE


Mind Body Mat will generally communicate with the Member by email, text or phone. By providing an email address and phone number, the Participants consent to receiving email communications regarding their class including notices pursuant to the Terms and Conditions. Participants also accept the risk that email may not be a secure and confidential means of communication. Mind Body Mat will not be liable for any loss or damage suffered as a result of communicating with a Participant by email.

12. CLASSES OPERATED ON BEHALF OF 3RD PARTIES

Mind Body Mat is from time to time contracted to run classes on behalf of third parties organisations. These classes will be subject to any terms and conditions of the third party organisation.
